TERMS AND CONDITIONS OF USE AND SERVICE
Welcome to the Sound Healing Massage website . These Terms and Conditions govern access to and use of this website, as well as the contracting of holistic services, massages, and sound therapies offered by Melisse Brambila (hereinafter, "The Provider"), operating as a natural person in the states of Quintana Roo and Yucatán, Mexico.
By browsing this website, submitting information or requesting a reservation, you (hereinafter, "The Client") expressly and without reservation accept all the clauses set forth herein.
1. Channels and Reserve Mechanics
1.1. Service booking requests will be handled exclusively through official channels: via WhatsApp at +52 994 139 2153 or by email to soundhealing.pdc@gmail.com . 1.2. The Provider has up to 24 hours to respond to requests, propose, or confirm availability through both channels. 1.3. In-Station Services: To guarantee and formally reserve an in-stage service time, the Client must make a reservation payment equivalent to $200.00 MXN via SPEI electronic transfer. 1.4. Home/Out-of-Station Services: The total service cost and corresponding fee will be determined individually when the formal quote is delivered to the Client.
2. Prices and Payment Methods
2.1. All service prices are expressed in Mexican Pesos (MXN) and include Value Added Tax ( VAT ). 2.2. If a tax invoice is required, the Client must expressly request it at the time of booking, providing their complete and up-to-date tax information. 2.3. Payment for the service: 100% of the cost of the contracted service must be paid before the session begins . 2.4. Accepted payment methods are:
For payment/confirmation: Electronic Transfer (SPEI) only.
For the remaining balance: Cash at the time of the appointment or Electronic Transfer (SPEI) prior to the start of the session.
3. Cancellation, Rescheduling and Refund Policies
3.1. Rescheduling Deadlines:
In the Treatment Room: The Client may reschedule their appointment date without penalty by giving a minimum of 24 hours ' notice.
Home Service: The Client may reschedule their service date without penalty by giving a minimum of 48 hours ' notice. 3.2. Penalties for Late Cancellation:
Any cancellation made outside the deadlines stipulated in point 3.1 will incur a penalty charge equivalent to 20% of the total cost of the contracted service.
If the Client notifies the cancellation on the same day as the appointment or does not show up ( No Show ), they will be obligated to cover 100% of the total cost of the service . 3.3. Deposit Policy: In case of late cancellations or No Show, the deposit amount ($200.00 MXN) will not be refunded under any circumstances, nor can it be credited towards future reservations.
4. Punctuality and Tolerance Policies
4.1. In the Treatment Room: The maximum grace period for starting the appointment is 15 minutes . After this time, the session will begin, and the delay will be deducted from the total duration of the contracted service in order to accommodate subsequent clients' appointments. 4.2. At Home: If the Service Provider arrives at the agreed-upon address at the scheduled time and the Client is late to receive them or begin the session, this delay will be fully deducted from the session's duration.
5. Special Conditions for Home Services and Travel Expenses
5.1. Services outside the physical treatment room incur an additional fee for transportation and travel expenses, which will be specified when the quote is prepared. This transportation fee must be paid in full at the time of booking to confirm the service and is non-refundable if canceled within 48 hours of the service. 5.2. Space Requirements: The Client is responsible for providing a clean, distraction-free space of approximately 2 x 2 meters for the safe setup of the massage table and individual instruments. For group sessions, the dimensions will be agreed upon beforehand according to the contracted experience. 5.3. Accessibility: The Client is obligated to inform us at the time of booking about the building's conditions: whether the service will be performed on the ground floor or on which floor, whether the building has an elevator, whether a parking space is available, and any access restrictions for bringing in the massage table and heavy instruments (gongs, bowls, etc.). This information is essential for calculating setup time.
6. Disclaimer of Medical and Therapeutic Liability
6.1. The Client expressly acknowledges and accepts that the sound massage and holistic experiences offered by the Provider constitute complementary, alternative, and wellness therapies . Under no circumstances do they substitute for, replace, or modify professional medical, clinical, psychiatric, or psychological treatment. 6.2. Contraindications and Precautions: Sound massage and vibrational therapy with ancestral instruments have specific medical contraindications. Their application is not recommended, or written authorization from the Client's treating physician will be required, if the Client presents any of the following conditions:
Epilepsy.
Use of pacemakers or electronic cardiac devices.
Metal implants in the body.
Severe psychiatric disorders.
Ongoing pregnancy during the first trimester. 6.3. The Client releases Melisse Brambila from any legal, civil, criminal or health liability for omitting information regarding the aforementioned medical conditions at the time of the session.
7. Jurisdiction and Applicable Law
For the interpretation, fulfillment and resolution of any controversy arising from the provision of these services, the parties expressly submit to the civil and consumer protection legislation applicable in the State of Quintana Roo, Mexico, waiving any other jurisdiction that may correspond to them by reason of their present or future domiciles.
